FAQ
Car accidents can be very traumatic, and afterwards, you may feel like your whole life has been turned upside down. If you are involved in a car accident or know someone who has, here are some tips on what to do after the accident:
1. Report the accident immediately:
Call 911 and report that you have been involved in a car accident. Once law enforcement arrives at the scene, explain how the accident happened in detail. If there are any witnesses, inform the officer. Request a copy of the police report or, if it is not available at that time, get the officer’s name, the name of the law enforcement agency, and crash report number.
2. Seek immediate medical attention:
Injuries sustained in car accidents vary from minor to severe. If you are experiencing any pain or discomfort, seek immediate medical attention. If medical assistance is offered at the accident scene, have the paramedics examine you. If necessary, go to the ER and have your injuries assessed by one of the doctors there.
3. Get the contact information of all parties and witnesses:
Information to collect includes the names of the driver of the other vehicle(s), the vehicle make, model, and license plate number, and their insurance information. Having this information is necessary for filing an insurance claim and will allow our staff to contact any witnesses and have them interviewed by a professional investigator.
4. Take photographs at the scene:
If possible, take pictures of all vehicles involved and any road hazards that may have contributed to the accident (construction barriers, potholes, debris, etc.). The more detail the better.
5. Call Us Today 786-891-3614:

Florida is one of about a dozen other states that have what is known as No-Fault Law. The No-Fault law is essentially an agreement between insurance companies and the Florida Legislature. Under the terms of this agreement, insurance companies are required to provide a certain level of coverage for insured clients if they are involved in a car accident, regardless of who is at fault. In exchange for this coverage, victims of an auto accident can only bring a claim against an at-fault party if they have sustained a permanent injury.
At Uriarte Law, we are available to discuss and explain all aspects of your case. Our advice is free, and we are here to ensure that you are properly informed about your rights and your options.

Personal Injury Protection, or PIP, is coverage that every driver in Florida is required to carry on their insurance policy. State law requires a minimum of $10,000 coverage on every auto insurance policy. If you are in an auto accident, PIP will cover or reimburse a portion of expenses including medical bills related to injuries sustained in the accident, lost income, prescription medication prescribed for injuries, and the mileage to and from medical facilities for as long as you receive treatment.
How do I claim PIP? No matter who is at fault, you will file a PIP claim with your own insurance company. If your own policy does not cover you, you may still qualify. You can do this through a relative you live with who owns an insured vehicle or as a passenger of an insured vehicle.
What if I don’t have PIP? Even if you do not have PIP, you should still seek medical attention. You can file a claim against the at-fault driver of the accident to receive compensation for medical bills.
Trying to understand your insurance coverage and benefits can be extremely confusing. Call us to find out how to file a PIP claim. We will walk you through the process, and make sure you get the benefits you’re entitled to receive. The consultation is free and we will discuss all your options with you.

There is a high likelihood that, at some time in every person’s life, they will fall and injure themselves. A significant number of these injuries attributed to slip-and-fall accidents happen because property owners fail to keep their premises safe from hazardous conditions.
If you have been injured in a slip-and-fall accident, the first thing you should do is to immediately complete a report describing the accident. Record the date, time, and circumstances of the fall. Include the names and contact information of all witnesses. A written statement from each of the witnesses is extremely helpful. Get the names of the property owner and/or their agents that were present at the time of the accident. If possible, take photographs of the fall location, your injuries and the defect that caused your fall while you are still at the accident scene. Photographs will prove useful information in the event you decide to make a claim.
If you are injured seek medical attention immediately. Minor injuries have a way of becoming major issues if ignored. The shock of the accident may mask injuries for some time. It is in your best interest to see a doctor or go to an emergency room the same day as the fall to document your injurie. This will be critical for supporting any claim you may make in the future. Make sure that you tell the examining doctor everything about the circumstances of the fall, as well as any pain and discomfort you are experiencing.
If your injuries persist, make sure that you continue to receive medical treatment. Medical records provide objective evidence of your injuries and are used to establish the value of your case should you choose to pursue legal action.
As with any personal injury claim, victims of injuries related to slip and fall accidents have the potential to be compensated for lost wages, medical bills and pain and suffering. Be certain to keep good records and collect supporting documentation for those potential claims.
You are likely to receive a phone call from the insurance company or risk management office of the owner of the property where the fall occurred. Remember that they represent the property owner and have their best interest in mind, not yours, so be cautious when providing them with any information concerning the accident and your injuries. You are best served by hiring an experienced, qualified personal injury attorney to represent you in this instance.
